US Judge Mandates Freedom of Abrego Garcia from Immigration Custody

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks legal authority.

"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.

The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his return to the United States to answer human smuggling allegations, he was detained in immigration custody.

In her order, the judge noted that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing trial in Tennessee.

Conditions of Release

The court, who was overseeing his petition to removal in a Maryland district court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This decision effectively transfers his monitoring to the jurisdiction handling his criminal case.
